Statement of Issues:
|(1) Is a particular finding of "impairment" -- defined in ORS 656.214(1)(a) as "the loss of use or function of a body part or system due to the compensable industrial injury or occupational disease" -- excluded from the rating of permanent disability if the fact-finder determines, based on the admissible medical opinions, that the finding of impairment is due 100 percent to causes other than the compensable injury?|
(2) Must a worker provide medical evidence that a specific impairment is due to the compensable injury in order to satisfy the worker's burden under ORS 656.266(1)?
