Statement of Issues:
Is the defense of guilty except for insanity (GEI) in ORS 161.295(1) available to a defendant if the defendant's lack of substantial capacity to appreciate the criminality of his conduct, or to conform that conduct to the requirements of the law, is the result of a combination of an otherwise qualifying "mental disease or defect" and a "personality disorder" (such as an anti-social personality disorder), as opposed to resulting from the mental disease or defect alone?

These summaries of cases are prepared for the benefit of members of the media to assist them in reporting the court's activities to the public.
