Statement of Issues:
|(1) Whether an earlier settlement agreement that had involved the Professional Liability Fund precluded the Oregon State Bar (Bar) from initiating disciplinary proceedings against respondent.|
(2) Whether, when alleging in its complaint that respondent had made false certifications, the Bar was required to state in its complaint the specific language setting forth the alleged false certifications that respondent purportedly had made in violation of ORCP 17 C.
(3) Whether the record supports the trial panel's conclusion that respondent violated RPC 8.4(a)(4); and
(4) If so, whether a one-year suspension is the appropriate sanction.
