Statement of Issues:
|(1) Whether the medical records are privileged as "confidential communications" under OEC 504-1; and|
(2) Whether the relators were precluded from claiming the privilege due to their affirmative defense alleging that defendant was suddenly and unforeseeably overcome by an incapacitating illness prior to the collision.
