Statement of Issues:
Whether, under Article I, section 9, of the Oregon Constitution, an officer seizes an individual if the officer tells the individual, who is a native Spanish speaker, in English that he "is not in trouble, you're free to leave, " then communicates in Spanish that he wants to search for drugs, and conducts a search after the individual says yes to a search in Spanish.
